 Man Receives Death Sentence by Hanging for Setting Mother Ablaze in Niger State




In a significant legal development, a Minna High Court 1, led by Chief Judge of Niger State, Justice Halima Ibrahim Abdulmalik, has pronounced a middle-aged man, Stephen Jiya, guilty and sentenced him to death by hanging for the brutal murder of his own mother, Mrs. Comfort Jiya.

The tragedy unfolded when the deceased, a former Principal of Government Girls’ Secondary School, Sabon Wuse, and Maryam Babangida Girls’ Science College, Minna, was set ablaze by her son, Stephen, in the kitchen of her residence in the Darusalam Area of Minna. The incident occurred on Monday, December 20, 2021, after Stephen, reportedly a drug addict, returned from Suleja.

Despite being rushed to General Hospital Minna and later transferred to another medical facility, Mrs. Comfort Jiya succumbed to her injuries.

Following the arrest of Stephen by the state Criminal Intelligence Department (SCID) of the Police Command, he confessed to the crime, attributing it to his mother's alleged interference in his marital affairs. Initial charges were brought before a magistrate court, awaiting legal advice from the Director of Public Prosecution (DPP) for proper prosecution.

On September 14, 2022, the DPP officially charged Stephen before Justice Halima Abdulmalik of High Court 1 under Section 221 of the Penal Code Law, which prescribes the death penalty if found guilty.

The trial, which commenced on November 22, 2022, concluded with the Chief Judge delivering her ruling on Wednesday, December 13, 2023. In her judgment, Justice Abdulmalik expressed conviction in the evidence presented, stating that all testimonies and evidence pointed to Stephen's undeniable responsibility for the heinous crime.

Despite the convict's plea for mercy, citing family obligations and a promise to change for the better, Justice Abdulmalik adhered to the stipulated punishment for culpable homicide, declaring, "In the circumstances, the sentence of the Court upon you is that you should be hanged by the neck, electrocuted, executed, or injected with lethal injection until you are dead. May the Lord have mercy on your soul.”

The trial featured six witnesses, including two family members and Stephen's younger sister, who testified against him, providing a comprehensive account of the tragic events leading to the death of Mrs. Comfort Jiya.
